Terms of use

The short version

Same Skies helps groups plan trips. We don’t sell travel: when you book, you book with the provider, on their site, under their terms. Prices we show come from third parties and can change. The assistant can make mistakes, so check before you rely on it. Shared costs are a record — we never hold or move money. Your rights under the Australian Consumer Law aren’t affected by anything here.

1. About these terms

These terms are an agreement between you and Julien Horrocks (“we”, “us”), the operator of Same Skies (the app, the web app and this website — together, the “service”). By using the service you agree to them. Our privacy policy explains how we handle personal information.

2. Who can use it

You must be at least 16 years old. You’re responsible for your account and for keeping your sign-in details secure. Guest accounts work on the device you use; add an email to keep your account if you change devices.

4. How we make money

The service is free. Some links to travel providers are affiliate links: if you book through them, the provider may pay us a commission. This doesn’t add to your price. Deals are chosen by price and how well they fit your group, not by commission. See how we make money.

5. The assistant and other AI features

The assistant, receipt reading and booking import use AI. They can misunderstand, miss things or be wrong. Changes to your plans and costs are shown to you to confirm before they’re saved — please check them, and check important details (like flight times) with the provider.

6. Shared costs

Expenses, bills, balances and “settle up” suggestions are records for your group to keep track of who owes what. We don’t hold, send or receive money, and we’re not a payment service. Payments between members happen outside the service, however you choose. Figures depend on what members enter and confirm, so check them before you pay.

8. Acceptable use

Don’t use the service to break the law, harass or harm anyone, post content that is unlawful, abusive or infringes others’ rights, send spam, access other people’s accounts or data, interfere with or overload the service, scrape it, or reverse engineer it except as the law allows. We may remove content or suspend accounts that break these rules.

9. Other services

The service links to and relies on third-party websites and services (for example airlines, hotels, booking sites and map providers). We don’t control them and aren’t responsible for their content, products, prices or practices; their own terms and privacy policies apply.

10. Our service

We work to keep the service available and accurate, but it’s provided as it is and as available: features may change, and there may be interruptions or errors. We own the service, its design and our brand; these terms don’t give you rights to them beyond using the service.

11. Ending your use

You can stop using the service and delete your account at any time. We may suspend or close accounts that seriously or repeatedly break these terms, and may discontinue the service with reasonable notice.

12. Australian Consumer Law and your rights

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded or limited. If you live in the EU, UK or elsewhere, you also keep any rights your local consumer law gives you that can’t be excluded.

13. Limits on our liability

To the extent the law allows:

Nothing here limits liability for fraud, or for death or personal injury caused by negligence, or anything else that can’t be limited by law.

14. Changes to these terms

We may update these terms as the service changes. We’ll show the effective date at the top, and for significant changes we’ll tell you in the app or by email before they take effect. If you keep using the service after that, the new terms apply.

15. Law and disputes

These terms are governed by the laws of New South Wales, Australia, and the courts there have jurisdiction — without taking away any right you have to bring a claim where you live under your local consumer law. If something goes wrong, please contact us first at support@sameskies.app; we’ll try to sort it out quickly.
